Digital Services Act

Information according to the Digital Services Act (Regulation (EU) 2022/2065, "DSA")

The Digital Services Act is an EU regulation that establishes obligations for online intermediaries and platforms operating in the EU. jpnthings.com (including its brand areas jpnthings, jpnthings Experiences, jpnthings Boosted and jpnthings Stays, hereinafter the "Platform") is an intermediary platform through which independent local service providers in Japan ("Suppliers") offer services for booking, and on which user-generated content (in particular customer reviews) is published. This notice sets out the information and procedures required under the DSA.

1. Provider and Single Points of Contact (Art. 11, 12 DSA)

Single point of contact for authorities of the Member States, the European Commission and the European Board for Digital Services (Art. 11 DSA) as well as for recipients of the service (Art. 12 DSA):

Languages for communication: German and English; communication in Japanese is possible for recipients of the service where feasible. Communication with our point of contact does not require any tools other than email.

2. Status as a Micro Enterprise

The Platform is operated by a sole proprietor and qualifies as a micro enterprise within the meaning of the Annex to Recommendation 2003/361/EC. Pursuant to Art. 15 (2), Art. 19 and Art. 29 DSA, certain obligations of the DSA — in particular the publication of periodic transparency reports and specific obligations for online platforms and online marketplaces — do not apply to micro and small enterprises. The Platform is not a "very large online platform" (VLOP) within the meaning of Art. 33 DSA. Irrespective of these exemptions, we voluntarily provide the information and procedures described below and comply with the obligations applicable to all hosting and intermediary services.

3. Notice-and-Action Procedure (Art. 16 DSA)

If you believe that content on the Platform (e.g. a customer review, an image or a listing description) is illegal or infringes your rights, you can notify us at any time:

To enable us to process your notice, please include:

  • a sufficiently substantiated explanation of why you consider the content to be illegal;
  • the exact electronic location of the content (e.g. URL) and, where necessary, additional information enabling identification;
  • your name and email address (except for reports concerning offences referred to in Articles 3 to 7 of Directive 2011/93/EU, which may be submitted anonymously); and
  • a statement confirming your bona fide belief that the information and allegations contained in the notice are accurate and complete.

We will confirm receipt of your notice without undue delay, examine it in a timely, diligent, non-arbitrary and objective manner, and inform you of our decision. If we remove or disable access to content, we will inform the affected user of the reasons (statement of reasons, Art. 17 DSA), unless we are prevented from doing so by law.

4. Content Moderation Practices

  • Customer reviews can only be submitted in connection with a completed booking (authenticity check). Reviews are moderated before publication. We check compliance with our content rules (Section 13 of our Terms and Conditions), in particular for untrue or misleading statements, covert advertising, infringements of third-party rights and unlawful content. There is no entitlement to publication.
  • Moderation decisions are made by a human; we do not use automated tools that autonomously remove or block content. Automated systems are used at most in a supporting capacity (e.g. spam and abuse protection at the infrastructure level).
  • Listing content (descriptions, images, prices, availability of the Activities) is created in coordination with the respective Suppliers and reviewed by us before publication.
  • If content violates our Terms and Conditions or applicable law, we may remove it, refuse publication or — in the event of repeated or serious violations — restrict, suspend or terminate the user's account, taking into account the principle of proportionality.

5. Complaints and Redress

If you disagree with a moderation decision (e.g. rejection or removal of a review, restriction of an account), you can contact us at any time at hello@jpnthings.com. We will review the decision internally by a human and inform you of the outcome. Your right to assert claims before the ordinary courts remains unaffected. You also have the right to lodge a complaint with the competent Digital Services Coordinator (in Germany: Bundesnetzagentur, Koordinierungsstelle für digitale Dienste).

6. Ranking Transparency (Main Parameters)

Where the Platform displays lists or search results of Activities, the default ordering is determined in particular by the following main parameters:

  • relevance to the selected brand area, category and search or filter criteria (e.g. date, number of participants);
  • availability for the selected period;
  • customer ratings and number of reviews;
  • completeness, quality and recency of the listing; and
  • popularity (booking demand).

Suppliers cannot pay for a better ranking position; there is no paid placement and no advertising on the Platform. Users can change the sorting via the displayed sorting and filter options.

7. No Advertising, No Profiling-Based Recommender Systems

The Platform does not display third-party advertising and does not use recommender systems based on profiling within the meaning of Art. 4 No. 4 GDPR. Optional, consent-based statistics are described in our Privacy Policy.

8. Average Monthly Active Recipients in the EU (Art. 24 (2) DSA)

As a micro enterprise, the Platform is exempt from the obligation to publish information on average monthly active recipients pursuant to Art. 24 (2) DSA in conjunction with Art. 19 DSA. Should the Platform exceed the relevant thresholds in the future, we will publish this information here in accordance with Art. 24 (2) DSA and update it regularly.

9. Protection Against Misuse of the Reporting Procedure

Notices that are manifestly unfounded or submitted repeatedly in an abusive manner may — after prior warning — result in the suspension of the processing of notices from the person concerned for a reasonable period (Art. 23 DSA applied accordingly).
